These terms and conditions form the basis on which you can visit and use SafeSplash. Please read them carefully as they contain important information.

Part A — SafeSplash App Terms
SafeSplash is a guidance tool that helps you interpret pool and spa water test results and provides suggested chemical dosing amounts based on values you enter. The App is designed to support — not replace — your own judgement and the advice of qualified pool professionals.
Important disclaimer: The readings, analysis, and dosing recommendations provided by the App are indicative only and are calculated using general industry guidelines. They are not professional, technical, or scientific advice. Actual results depend on many factors including your pool's circulation, bather load, weather, and the specific products used. Always follow the instructions on any chemicals you use.
HeatPumps4Pools Limited accepts no liability for any loss, injury, or damage arising from reliance on the App's analysis or recommendations. You use the App at your own risk and remain solely responsible for the safe maintenance of your pool or spa.
The App is provided free of charge for personal, non-commercial use in connection with the maintenance of a residential or small commercial pool or spa. You agree not to:
We reserve the right to suspend or terminate accounts we reasonably believe are in breach of this Fair Usage Policy without prior notice.
You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Please notify us immediately at hello@safesplash.co.uk if you believe your account has been compromised. Accounts are for individuals aged 18 or over.
We aim to keep the App available at all times but cannot guarantee uninterrupted access. We may update, modify, or discontinue features at any time. We will endeavour to give reasonable notice of any significant changes. We shall not be liable for any loss arising from App downtime or unavailability, except where required by law.
All rights, including copyright, in the SafeSplash App and its content are owned by or licensed to HeatPumps4Pools Limited. Any use of the App or its contents, including copying or storing it in whole or in part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute, or repost anything from the App for any purpose.
Part B — Product Purchases
Products available in the SafeSplash Shop are sold by HeatPumps4Pools Limited. Payment in full must be received before dispatch. Payment of the price for goods represents an offer on your part to purchase the goods, which will be accepted by us only when the goods are dispatched. Only at this point is a legally binding contract created between us.
Payment is processed securely by Stripe. We do not store your payment card details. All prices are inclusive of VAT at the current rate.
We will deliver goods to the address you specify. Most orders over £100 have free delivery to a UK mainland address; delivery to areas outside mainland UK (Scottish Highlands and islands, Channel Islands, Northern Ireland, Isle of Wight, Isle of Man, etc.) may incur an additional charge. We aim to deliver within 30 days from the day after receipt of your order.
On taking delivery you must check goods for damage while the courier driver is present. If damage is found, sign the delivery note as “damaged”. You must notify us of any damage within 2 days of delivery at hello@safesplash.co.uk. Failure to do so may prevent us from claiming against the carrier.
Risk of damage to or loss of goods passes to you at the time of delivery. Title to the goods shall not pass to you until payment in full of all sums due to us has been received. Until title passes, you must keep the goods separate from your other property and clearly marked as belonging to HeatPumps4Pools Limited.
Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the legal right to cancel your order up to 14 calendar days after the day on which you receive your goods (with the exception of any made-to-order items). You do not need to give any reason for cancelling.

If you have received the goods before cancelling you must return them to us at your own cost and risk. We will refund any sum debited within 14 calendar days of receiving the goods back. We may make a deduction from your refund for any loss in value if the goods are not in new, unused, resellable condition (including missing parts, damaged packaging, or signs of use).
At our discretion we may accept returns outside of 14 days but within 28 days of purchase, subject to a 25% + VAT restocking charge and the customer being responsible for return shipping costs.
These cancellation rights apply to consumers only and do not apply to business-to-business purchases unless agreed otherwise in writing.
We are under a legal duty to supply goods that conform with this contract in accordance with the Consumer Rights Act 2015. If you wish to exercise your legal rights to reject non-conforming goods, please contact us at hello@safesplash.co.uk.
Part C — Data Protection & Privacy
HeatPumps4Pools Limited is committed to protecting your privacy. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and act as data controller in respect of personal data you provide to us.
We collect and use:
We do not sell your personal data to third parties. We may share data with service providers acting on our behalf (Stripe for payments, Resend for transactional emails, HubSpot for CRM, Ordoro for order fulfilment) under appropriate data processing agreements. We may also enter your email address into courier websites so that you can receive tracking emails.
We do not store credit card details. Payments are handled directly by Stripe.

We will only send you marketing emails if you have opted in during registration or subsequently opted in via your Account settings. You can withdraw your consent at any time by updating your preferences in the App, or by emailing hello@safesplash.co.uk.
Transactional emails (welcome emails, order confirmations, password reset) are sent regardless of your marketing preferences as they form part of the service.
If you consent to marketing, your contact details may be used by HeatPumps4Pools Limited to send relevant communications about pool maintenance, chemicals, and heating products. You may opt out at any time.
We use cookies to enable the App to function and to understand how it is used. Essential cookies are required for the App to work. You can disable non-essential cookies in your browser settings, but this may affect functionality. For more information on managing cookies, visit allaboutcookies.org.
Part D — General
To the fullest extent permitted by law, HeatPumps4Pools Limited's total liability to you in connection with the App and any products purchased shall not exceed the total amount you paid for the goods giving rise to the claim. We shall not be liable for any indirect, consequential, or incidental loss including lost data, lost profits, personal injury, or loss of use of a pool arising from your use of the App or reliance on its recommendations.
We do not accept any liability for the death or damage to fish or other livestock. We also do not accept liability for consequential losses related to pool equipment, including electricity costs, labour, transport, or loss of use.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
We reserve the right to change these Terms at any time. We will post the updated Terms on this page with a revised “last updated” date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
If any part of these Terms is unenforceable, the enforceability of any other part of the Terms will not be affected.
Nothing in these Terms is intended to confer any rights on a third party.
